5. Service Guarantees

5.1 90-Day Ranking Guarantee

Where we offer a "90-day first-page ranking guarantee", the following conditions apply:

  • Guarantee applies to agreed local keywords only
  • Keywords and targets are defined in writing before work begins
  • You must provide timely access to required platforms (website, GBP, etc.)
  • You must not make changes that contradict our recommendations
  • If targets are not met, we will continue working at no additional cost OR provide a refund as specified in your service agreement

The guarantee does not cover:

  • Google algorithm changes beyond our control
  • Penalties resulting from your actions or prior SEO work
  • Keywords where competition makes 90-day ranking unrealistic (disclosed upfront)

5.2 No Guaranteed Results

Except where explicitly stated in a written guarantee, we do not guarantee specific rankings, traffic, leads, or revenue. SEO and marketing results depend on many factors outside our control.

6. Payment Terms

  • Payment terms are specified in individual service agreements
  • Invoices are due within 14 days unless otherwise agreed
  • We accept bank transfer, card payments, and other methods as specified
  • Late payments may incur interest at 8% above the Bank of England base rate
  • We reserve the right to suspend services for overdue accounts

7. Cancellation and Refunds

  • Monthly retainer services may be cancelled with 30 days' written notice
  • Project-based work: cancellation terms are specified in the service agreement
  • Refunds for work already completed are at our discretion
  • Deposits are generally non-refundable once work has commenced

8. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability for any claim is limited to the fees paid for the relevant service
  • We are not liable for indirect, consequential, or incidental damages
  • We are not liable for loss of profits, revenue, data, or business opportunities
  • We are not liable for third-party actions (e.g., Google algorithm changes, hosting failures)

Nothing in these Terms excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded by law

9. Indemnification

You agree to indemnify and hold harmless Heimdell Tech AI Ltd, its directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your breach of these Terms
  • Your use of our services
  • Content you provide to us
